Acceptance of Terms

By accessing and using ezenciel, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Service Description and Beta Nature

ezenciel is a beta platform that provides AI-powered social media automation tools for Twitter and TikTok. THIS IS A BETA SERVICE provided “as-is” without any warranties or guarantees of functionality, accuracy, or reliability. You acknowledge and agree that:

  • The service is experimental and may contain bugs, errors, or incomplete features
  • Features may change, be removed, or become unavailable at any time without notice
  • We make no guarantees about service uptime, availability, or performance
  • You use this beta service entirely at your own risk

Platform Nature - No Content Responsibility

IMPORTANT: ezenciel is strictly a platform that provides tools. We are NOT responsible for any content generated, posted, or distributed through our platform. By using ezenciel, you acknowledge and agree that:

  • ezenciel has ZERO responsibility for any content output
  • We are a technology platform provider only, not a content creator or publisher
  • All content decisions, reviews, and approvals are solely your responsibility
  • We do not endorse, verify, or take responsibility for any AI-generated content
  • You are solely liable for all content posted through our platform

AI Content Verification - Your Obligation

YOU MUST VERIFY ALL AI-GENERATED CONTENT BEFORE PUBLICATION. By using ezenciel, you explicitly agree that:

  • You will review and verify every piece of AI-generated content before posting
  • AI-generated content may contain errors, inaccuracies, or inappropriate material
  • You are solely responsible for fact-checking all generated content
  • You will not post any AI-generated content without personal review and approval
  • ezenciel makes no warranties about the accuracy, appropriateness, or quality of AI output
  • You assume all risks associated with AI-generated content

User Accounts and Responsibilities

Account Creation

  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • You must be at least 18 years old to use the service
  • One account per person or organization

Acceptable Use

You agree to use ezenciel only for lawful purposes and in accordance with these Terms. You will not:

  • Post harmful, offensive, or illegal content
  • Violate any social media platform's terms of service
  • Engage in spam or harassment
  • Attempt to reverse engineer or hack the service

Content and Intellectual Property

You retain ownership of content you upload to ezenciel. By using our service, you grant us a license to process, analyze, and use your content solely to provide the platform service. You are fully responsible for ensuring you have rights to all content you upload and all content you publish.

Generated Content Disclaimer

AI-generated content is provided as a tool output only. ezenciel makes no representations or warranties about AI-generated content. You are solely responsible for:

  • Reviewing all AI-generated content before use
  • Verifying accuracy and appropriateness of generated content
  • Ensuring compliance with platform policies and applicable laws
  • All consequences of posting any content through our platform

Payment and Billing

  • Fees are charged on a pay-per-use basis for this beta service
  • Payment is due immediately upon service usage
  • All fees are non-refundable due to the beta nature of the service
  • We reserve the right to change pricing with or without notice during beta
  • Taxes are your responsibility where applicable

No Service Guarantees

WE PROVIDE NO GUARANTEES OF ANY KIND. This includes but is not limited to:

  • No uptime guarantees - service may be unavailable at any time
  • No performance guarantees - features may not work as expected
  • No data retention guarantees - your data may be lost
  • No content quality guarantees - AI output may be poor or inappropriate
  • No integration guarantees - third-party platforms may stop working

Third-Party Platforms

ezenciel integrates with third-party social media platforms. We have no control over these platforms and are not responsible for their policies, changes, or actions. You must comply with their terms of service. We are not liable for any issues arising from third-party platform usage.

MAXIMUM LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • ezenciel provides this service “AS IS” with NO WARRANTIES of any kind
  • We are NOT LIABLE for any damages whatsoever arising from your use of the service
  • Our total liability is limited to the amount you paid us in the last 30 days
  • We are not liable for any content posted, generated, or distributed through our platform
  • We are not liable for social media account suspensions, bans, or penalties
  • We are not liable for business losses, data loss, or any consequential damages
  • You assume all risks associated with using this beta platform

Indemnification

You agree to indemnify and hold ezenciel harmless from any claims, damages, losses, or expenses arising from:

  • Your use of the platform
  • Any content you post or generate through our service
  • Your violation of these terms or any applicable laws
  • Any third-party claims related to your content or account

Termination

Either party may terminate this agreement at any time without notice. Upon termination, your access to the service will cease immediately, and we may delete your data without liability. No refunds will be provided upon termination.

Changes to Terms

We may modify these terms at any time without notice during the beta period. Continued use after changes constitutes acceptance of new terms. We recommend checking these terms regularly.

Governing Law

These terms are governed by applicable law. Any disputes will be resolved through binding arbitration, and you waive any right to class action lawsuits.
